Default Paternity, Birth Certificate and Child's Last Name in Louisiana
Hi. I am having my baby in November, and live in Louisiana.
I'm not sure if the father will be able to be there for the birth, or if the baby will have his last name at first.
What are the laws in Louisiana and how would I go about getting him to sign the birth certificate and changing the last name to his?? I read somewhere that we would just have to go somewhere to make there cahnges and he wouldnt have to adopt. Is this correct? I would hate for him to have to adopt his own child.
Any information would be appreciated.

You can name the child what ever you want...You could name your baby George W. Bush Jr. if you wanted... ...Your bf can file for paternity and be added to the BC when he is determined to be the legal father.

Thanks, but i still dont understand, he knows he is the father, when he is ready to sign the BC and give his last name, why does it have to be deteremined?
Can he just go and say he is the father and he needs to sign?

If he wishes, you and he can sign an acknowledgment of paternity at the hospital when the baby is born.

thanks guys
he should be there for the birth, but its a complicated situation.
he wants to wait to sign and give his last name. I am just trying to figure out how much trouble that would be, i can't see having to do a dna test and stuff just to change it later on.
if he agrees that he is the father when hes ready to sign, is a test or court necessary?

let me be more specific so i can possibly get more help.
he is currently married. not yet filed for divorce.
but will have and will be seperated by time i give birth.
his wife does not know, and he's trying to keep it that way.
he just wants to make sure he is in the clear before his name is on the BC and given to the child.
i personally would rather just have him to it at the birth, but agreed to do what was best for his situation.
help?!
