Default Employer's Liability Without Worker's Comp Insurance
Hello,

I am taking the position of the employer and we fall under Georgia law. The law states we do not need to get WC since we have less than three employees. However, in the event one of our two employees DOES get hurt during working hours (and while doing their job) what happens? I feel the employee would seek medical attention and our group medical (or their personal medical) insurance would cover the injury. Can someone advise me?

Default Work-related injury
Typically, where an employer is not required to obtain workers' compensation insurance and does not do so, the employer risks being held liable in tort for any negligence which contributes to the employee's injury, as the exclusive remedy provisions of workers' compensation law do not apply. You would benefit from discussing the nature and scope of your present insurance policies with your insurance agent, to determine if your present liability policies provide sufficient protection.
