Default What Are A Mother's Rights
Hello, I am currently 34 weeks pregnant. I am 100% percent sure of my conception date as it also coincides with the estimated due date given by my doctor based on numerous ultrasounds (especially the early ones which are accurate + or - 3 days). My dilemma is as follows: An ex-boyfriend, who is not a part of my life and lives an hour away, heard through the grapevine that I am pregnant. I am with the father of my child and he is, without a doubt, the father. However, my ex doesn't believe me when I tell him that the baby is not his and what my due date is. I wasn't with this ex for well over a month before I got pregnant and can account for my whereabouts the entire month prior to conception (further proving that I was not anywhere near this ex when I conceived). I got a letter in the mail from a lawyer representing this ex the other day telling me that I am going to have to go to court and submit to a DNA test when the child is born. Knowing that the child is not his, what rights do I have in denying to subject my child to any unecessary test. I have been told "just give him the test and get it over with." However, at this point it's about principle and the fact that he could get a pregnant woman so upset is horrible so I will do whatever I can to avoid this test. I live in Pennsylvania and really just want to know what rights I have in this matter. Does he have to prove that he was with me around the time of conception or can anyone at anytime just put someone through this? How long does it usually take after a petition is filed to actually have to take the DNA test? And is it going to cost him more money for his lawyer and testing now that they have to file a petition in the court (I am hoping so)? One more thing...the father of my child knows the whole situation and has no doubts either as to whether or not the baby is his. He is not the type of guy that wants to raise someone else's child. When the baby is born he will be listed as the father, sign the Birth Certificate, and acknowledgent of paternity form. I would appreciate it so much if you could give me some advice on this matter. If he brings a paternity action, you can expect that the child will be tested. It's normally done by cheek swab these days, which is painless for the child.

There's a very easy way to end the problem- when the baby is born the exBF can file for paternity. You will be court ordered to submit you and the baby to a DNA test. As aaron said, it is totally painless, then when the results confirm that he is not the father, the problem will resolve itself.
