Driveway and Utility Easement

I have purchased a 10 arce lot of land in Georgia.....
My lot is behind two 5 arce lots.There is a 60 foot driveway/ utility easement that runs down both 5 arce property line....30 foot on each side...
I am responsable for upkeep and maintance to the easement....Started building house last week and noticed one of them had starting building a fence
which is only 14 feet off the center line of driveway..The fence has also covered all utilitys....Tryed to talk to him but he says property is his and he will build fence were he wants....Before i take him to court does anyone have any experience with this sort of problem??????

Have you attorney send him a letter explaining your rights to the easement and that building a fence is burdening the easement. The first letter should be nice since you are going to have to live next to him. If he does not respond, the second letter should give him ten days to take down the fence or you will take it down and send him the bill.
