Default Removing A Name From A Florida Birth Certificate
My boyfriend finally listened to me and got a paternity test. He found out that he is not the father of a child he has been taking care of for the first 6months of his life. The child was named a junior, and now we need to know how to get his name removed from the child's birth certificate. I printed a lot of forms off the internet, but I'm not sure if he needs to fill them all out. What forms do we need? Can this process be done without a lawyer? Is there a chance the court won't let him remove his name even though he was made to believe it was his child and we now find out that it isn't?

Did he sign an acknowledgement of paternity?
Has he been adjudicated the legal father through any type of court order? (custody, CS or other)
Was the paternity test through a court order?

Is the child's mother willing to agree to a name change and a legal disestablishment of paternity?

He signed whatever they give you to sign at the hospital because she led him to believe he was the only possible father. She had the baby about 6months ago. He has never been through any court proceeding regarding the child. He only recently found out (private, at home test) that he not the biological father. He is willing to get a DNA test through the court system, I don't know how cooperative she will be in this process because she still claims the child is his yet she doesn't want another test (because she knew the truth from the beginning). Since he signed the paperwork (which I'm not sure if it was the acknowledgement form, but probably so), because of a misreputation of of information from his ex will he be able to go through this process. We want to name our child (once we get married and have some) Jr, and we don't want any identity theft issues, or confusion with documents since they will live in the same city. If the child's mother willing to agree to a name change and a legal disestablishment of paternity is this process guaranteed to work?
