Question Ex-Husband Let Somebody Take Car
My ex-husband has let a third party take over a vehicle that is financed in both our names. This person has made the last 7 payments over 30 days late. The creditor sent a letter to catch up payments or they will take the car. As of 7-10-07 May 30th payment has not been paid. My ex lives in one state (CO) and the car is in another (NM) me in another (TX). I know the states but not the exact locations of either. If the creditor goes to repossess the car and can't find it what can they do? Also, is there anything I can do. I have sent an offer through a mutual friend that I would take the car and finish paying it. I havent' heard anything back. I feel I need to protect myself but don't know how.

Is the car titled in both your and your ex-husband's names?

Yes, the title is in both names.

Is there something in the divorce decree that gives your ex- exclusive possession? If not, why don't you go and pick up the car? If so, why doesn't he?

The divorce decree states he has "all rights title and interest". I'm almost sure that the car is still in Clovis, NM but who has it and where it is I don't know. I know by other items on my credit that he is having financial problems. I've had to change my phone number because his creditors started calling. After deciding he wanted to live with someone else, he purchased 2 other vehicles and an RV for him and his new wife. I don't think he can afford the payment. The man cannot live within his means.
