Default Level Spreader in Back Yard

I'm in NC. I bought a house about 4 months back with a 10ft driange/sewer easement that goes through my backyard and a riprain buffer of 50ft attached to that. About a month after I bought the house the developer dug up the 10ft easement area and installed a big pipe coming from the side by detention pond. When I asked the previous owner he told me that the builder told him that there will be something underground and when I asked the developer they said they can't do that and they said they can't even move it as it has to be 50ft from the creek. Now pretty much the whole 60ft stays wet all the time making it pretty much useless and all types of garbage flows into my backyard through the pipe that they had for the level spreader. Eventhough they had only 10ft of easement the level spreader pretty much made the whole 60 ft useless. I wanted to know if this usual or if I can do something to get the builder to do some thing to not effect the other 50ft of riprian buffer?

    Thank you

You can consult with an attorney but it sounds like they are within their rights. There may be something that can be done to improve the situation but it probalby will be at your expense.

What about flooding caused from level spreader into the 50ft of riprain buffer which I can probably use with out removing big trees and most of the times water stagnates in some particular areas breeding mosquitos?

    Thank you
