You are in a commercial lot after hours ... it is very likely they CAN arrest or cite you. The fact that they are choosing NOT to do so shows a measure of restraint on their part ... obviously you don't seem to represent much of a danger to public safety to them.

Make sure to double check your loitering laws.

Most of CA's local loitering laws have been tossed by the courts. It's hard to loiter on a public sidewalk, and hard to loiter in a public park. Most agencies will rarely enforce them unless they have been re-written or they REALLY want to contact the subject in question.

Beyond the trespassing laws you are most likely violating the law by accessing the wireless network. Do you have explicit permission to access the network or is the network explicitly expressed as a public network? If not you are breaking the law.

the cop asked me like the netnovice iknew he was if i was "hacking into the internet".. I told him no. I amon unsecured networks. If I was hacking id go to the signals reachin inside myhouse not outdoors. While a lack of defense does not warrant an invasion i think the intent of the unsecured networks is to share. It streches all the way into the streets anyway and i think the option of security is always offered.

Here, you a very wrong and may end up paying the consequences. What you have stated would be the same thing as entering an unlocked house and claiming it to be legal merely because the house could be locked but wasn't so it made it accessible to all.

You are wrong. It is still private property and must be treated as such.

Your connections, unless intended for public use, are private connections and you utilizing them is illegal. Jut because I have not secured my wireless connection does not mean you can use it. If you think about it, the only reason we have locks and security are because there are always some people that do not respect the property of others and we must lock it up to prevent it from being used/stolen. If there were no thieves, we wouldn;t need locks, or secure connections.
