Two Parties Garnished For The Same Auto Loan
I live in Michigan. In 2002 I bought a car, with my mom as the co signer. While going through a divorce in 2004, I missed two payments and my car was repoed. It was sold at auction, the remaining balance being appx. 9000. My mom was sued, and her paychecks are being garnished for 184. per paycheck. I have been paying my mom most of what is being taken. She makes 9.00 and hour, and her take home pay after the garnishment, taxes and insurance is only a little over 600 per month. She just can not make it on that. What is the law regarding garnishments for both of us for the same loan at the same time? My understanding was that if I did not pay, my mom was agreeing to do it. I would rather my checks be garnished, obviously. My concern is if I am also served and a judgement entered for garnishment against me (the process server keeps going to my mom's trying to find my address) I will be unable to pay my mom any money if I am having money taken from my check as well. How can I stop her garnishment? For the already mentioned reasons, I am hesitant to contact the creditor. I am a full time college student, work full time, and a single parent with 4 children.
