    Default Military Immigration

Hello- My fiance is in the British Army (currently deployed in Middle East) and it doesn't look like his fiance visa will be approved by the time we have been planning to marry in Dec. He has been thinking of joining the National Guard here in the US and there is actually a program between his army and the NG to do this. However I'm wondering if the U.S. Military ever sponsors visas foreigners who are coming over to serve? I have never heard of this but thought someone here might know. We had not planned on going that route, if it even exists, but due to the fiance visa snag I thought I would ask!

do you mean the U.S. paying for his trip? I'd think he'd need to come over on his own or go to a military base. You could call your recruiters around town and they'd know. I assume his service will just make the process easier. Even those ten million illegals you hear about on the news must serve in the service if they are male and of theage.

Not exactly; we're happy to pay for him coming here. The problem is that he won't be able to legally work, and we won't be able to legally get married in Dec. (because if he enters on just a plain visitor's visa, it will be considered fraud since we clearly intended to get married). What I am hoping is that the National Guard might be able to secure his visa for him to legally work as soon as he gets here and joins up with them, as he would need to have another job to viably survive while in the service.

I am not aware of any such programs. He can always contact a National Guard recruitment office and ask.

This isn't legal advice, but just from my own experience in the military. Assuming you're a US citizen, it is possible to sponsor him and bring him over here, however, you're probably going to have to wait till his paperwork goes through. It's a pain, I know. A couple I know it took almost two and half years, and she's CANADIAN! Oh, and they were already married. If you're in the US military, go talk to your personnel officer.

You can sponsor a foreign national on a visa, but you have to be married FIRST. Basically, if you're military, everything works backwards. Also, the military will then pay for him to move when you transfer. You can also talk to the recuriter on your base about hims transfer to the US military.

Just a few jems of experience.

    Chris
