Unhappy Need Guidance Regarding Possible Paternity
I was involved with a married woman a couple of years ago, while she was separated, but she got back with her husband. She was pregnant, but she's not sure if it’s his or mine. I only found out that she was pregnant and didn't here from her again until about a month after the baby was born. The husband claimed him as his own, but that's not what I wanted. I've wanted to get a paternity test done ever since, but she doesn't really want to. Especially since the baby looks more like me and absolutely nothing like him. The baby is currently 2 yrs old and I'm dying to know if he's mine or not. I want to be a part of his life. I don't know what right's I may have, if any. What can I do? If we were to get a test done and it came out positive, could I do something about it? I know that the husband won't agree at all to share custody and much less agree to let me give him my name... Someone told me once that I don't have any rights at all, because the baby was born within a marriage and because of the fact that she was still legally married. WHAT CAN I DO? Anybody....

well, with no state given, all you are going to get is some general advice and input.

address the family court and request a determination of paternity be ordered by the court.

in some states, there are time limitations to do this so you may not be successful.

in some states, a child born of a marriage is legally considered to be the husbands.

any more general advice needed?
