    I have a question about about defamation
    I have a marine who came from another unit last year
    a few days a gunny that he had some bad history
    with showed as part of an inspection team
    the marine found later on that , that gunny had
    his boss about the history that he once had with gunny
    and during a meetin it was brought up
    I was wondering if that marine could take any
    recourse against that gunny for now tarnishing
    his image to his superiors

    I am sorry about the wording but
    from what I am getting from Mr Knowitall's response
    in order for him to be able to do anything
    the statements that the gunny made about him
    would have to be false

    and let me guess
    the way the UCMJ defines Slander is only if the statements
    are false
    correct?

    I am not aware of any definition of slander which encompasses statements that are true.

    So basically, even that marine had has changed and cleaned , there is nothing that preventing someone from their past with a grudge from coming and pretty much wrecking everything that marine has accomplished since then

    Slander has to be false. Oftentimes the burden of proof is on the person slandered to prove it's not true.
