Default Re: Rickenbacker Collections - Mistaken Identity
Okay this company has done the same thing to me. I'm tierd of dealing with them and want to know what I can do. Some car was towed in California and the lady that owned it said she sold it to a Dale Sennie. I called the DMV and they wont give me any information on the car because I never owned it. They said the lady just sent in the form saying Dale Sennie bought it from her. No signature or anything. I live in Virginia and I never owned this car they are talking about. What can I do? They have no social, DL, Signature but that means nothing to them. I have proof of military service, school, job, bank statements, and residence in virginia 5 years before it happened and up to present day. This still is not good enough for them. What else can I do to prove myself? and why do I have to go through all this headache? Shouldnt they be able to prove it was me based on more than my name?

If it were me, I would sue them for a declaratory judgment or (if I could identify one) an FDCPA violation, and have a court rule on the issue.

I thank you for the advise! I'm trying to take legal action on them now.
