    Default American Citizen Married To An Illegal Immigrant

    hi to all!

    i just have a question to all of you, anyone who could give me information would be appreciated. and thank you in advance.

    here's my problem, i married someone in the philippines year 2005, however we were told from their embassy that the process would be 2 years due to the people who have applied before us. my husband decided to take the risk of crossing the border in mexico. yes he made it safely, by now he's been here for 1 year and 3 months. 5 months ago we went to a lawyer and asked for a legal advice. the lawyer told me that i can file for him here, but he needs to go back to his country and wait until he was approve. i am not rich i cannot afford not to work for those years, and it will be hard for us to be apart knowing that we are just newly married. so we didnt file as the lawyer said that we could wait for the new immigration reform coming, well anyway it seems to me that it wont happen, i dont want to consult a lawyer yet because i will be charge 100 bucks for the answers that i may need which is possible that i may get from here.
    knowing that they failed to pass the bill, how about for people like me who is american citizen but married to an illegal immigrant? i was thinking that we may just be oblige to pay a certain fee and be able to file here and wait here, i really dont want to be away from him. pls pls help me.

    by the way im sorry if my english is not that good, i only have papers but still have the accent (my mother tounge philippines)

    He can't adjust his status on the basis of marriage, as he entered illegally. If he is detected in the country, he can be deported. If he leaves the country and his presence is known (or becomes known) by the USCIS, he will be subject to a lengthy period of ineligibility from reentry.

    There are no easy answers here. While I understand your not wanting to get help from an immigration lawyer, you really should.

    are u serious sir? oh my gosh! i can't believe what u just said. he might be deported or be banned? i guess i should take your advice to consult a lawyer instead. by the way thanks a lot. you are the only one who answered to my post. i appreciate your effort..
