    Question Trading In Disabled Father's Car

    Hello, I'm new to this forum and I hope I'm posting to the right category.

    My father is the victim of two strokes: the first one left his mind like a child, the second took away his ability to speak and write.

    He is now in a nursing home, but the title of his car is still in his name. The car is constantly breaking down and my mother and I want to trade it in for a new one, however since the car is in his name and he doesn't have a power of attorney or representative at the moment, I have no idea how to go about doing this legally.

    Is there a way to do this?

    Also, is there a way to become his power of attorney even though he can't sign the necessary documents or give verbal consent?

    You need to petition for a conservatorship. You may wish to seek a guardianship at the same time. You can find information about Alabama guardianships and conservatorships here.
