    Default Age of Consent to Adoption in Florida

    I have been at war with my 8 year olds father for, well, 8 years. I haev been remarried for 6. I live in Florida and my ex lives in NC. (All cases are in Florida)

    My husband wants to adopt my child, but my ex will not signover his rights because " I want him to". He only see's this child maybe once a year, and only pays child support because he has a state job and we have court ordered garisments on him.

    How old does my child have to be before he can go to a judge and say "this is whatI want"? Will he ever be old enough to out weigh what his "father" wants?

    Yes, there will be a time when your son's wants will out weigh his father's- when he is 18. The day he turns 18 him and your husband can do an adult adoption. This will make your husband his legal father forever, and he will not need your ex's consent, nor will your ex be able to contest the adoption.

    Since the circumstances don't allow an involuntary TPR/adoption while your son is still a minor, waiting until he is 18 will most likely be the best route to take. In the mean time your son and husband can have a "father-son" relationship without it being legalized, and you will have the added benefit of recieving CS for your son.
