Default Do I Qualify For Emancipation

I am 16 (almost 17) years old and living in California. I have been living with my biological parents for my whole life. In middle school, my parents were reported to CPS for child abuse. The abuse was not sever and they only got a warning. Since then, they had stopped. I believe my parents are over controlling and preventing me from achieving my career goals. The main issue right now is because of college. I do decently well in school (3.7 GPA unweighted). I just graduated as a junior and have been accepted into a program called Middle college. That means that I'm able to spend my senior year at a community college competing my GED as well as starting my college transcript. Through this program, I plan to obtain enough credits to only spend one more year at the community college and transfer as a college junior. They aren't allowing me to do the program because of incidents that have happened with my boyfriend. I know of many people that would take me in and house me, and of course I would pay them rent. Also, I have my own job making around 200 twice a week during high school. I will be able to make more now that it's summer. I know that my parents would most likely not sign the forms, forcing me to go to court and ask a judge to declare my emancipation. I would like to know how likely it is that I would be able to be emancipated.

    Thank you.

Do you have a job and can you support yourself 100%? If not you cannot be emancipated

I do have a job. However, I've only been working about 16 hours during the school year. I'm able to work more now that it's summer. I'd be able to pay for rent if I lived at my friend's house. I wouldn't be able to pay for rent if I were to get my own apartment.

You can find a lot of information on California emancipation here.
Quote Quoting How do I get emancipated?
There are 3 ways to get emancipated:

    1. Get married. You need permission from your parents and the court.

    2. Join the armed forces. You need permission from your parents, and the armed forces must accept you.

    3. Get a declaration of emancipation from a judge. To get a declaration of emancipation, you have to prove ALL of these things:

    • You are at least 14 years old.
    • You don't want to live with your parents. Your parents don't mind if you move out.
    • You can handle your own money.
    • You have a legal way to make money.
    • Emancipation would be good for you.

16 hours at what pay rate? also once school starts again how many hours will you work? What if your friend leaves or loses her job? these are questions a judge will have before granting your petition

It would be my friend and her family. I'm really close with her whole family and they've helped me through a lot of situations already. My pay rate is 8.50 an hour, and i also get tips. Once school starts I'll also be able to pick up more hours because I'll be a senior in high school.

I want to know if my case would likely get passed.

We are not in the business of predictions! Emancipation is NOT easy and was not intended to be easy.
