    Default DIB Reconsideration Level

    I got my first denied from Social Security August 2004. I put in for Reconsideraton on 13 Sept 2004, I had 60 day deadline to appeal. I was admitted to the Hospital on 6 August 2004 and discharged from the Hospital 25 August 2004. I had a Hip Operation on my left side. I went into the Rehab on 26 August 2004 and was there until 23 Sept 2004. I have several doctor told me I can't work no more because my time in service. I have psysical limitation to, I can't sit, walk, stand, etc. I have ask my Congressman to help me with my SSDI claim. I am still have job, but I have not work over four months now because I am still on sickcall.

    My question, since I am at the Reconsideration level, is it a good idea to obtain a lawyer before I recieve my second Denial. thank you Kirby

    Default Appealing a Social Security Disability Denial

    I'm pretty up front with my opinion on the use of a lawyer for a Social Security Disabilty Appeal:
    To maximize your chances on appeal, it is very helpful to use a lawyer who is familiar with the Social Security appeals process. However it is possible to pursue your administrative appeals without a lawyer. The Social Security Administration limits the amount an attorney can charge a client for Social Security proceedings (but not for appeals in federal court).

    In the event that your initial appeals are denied, it can be quite difficult to prosecute a lawsuit in federal court without the assistance of a lawyer.
    In short, I think a lawyer can be very helpful with an appeal.
