    Default Putting A FiancÚ's Name On The Birth Certificate, And Adoption

    My girlfriends roomate has a son, she had him with this guy who is no longer in the picture, she I guess talks to him but it is usually arguments about how she deserves money from him. He is not on the birth certificate and they have never been to court. She is now engaged to another guy and are having a baby together, since her son's father has no rights, couldnt she have her husband/fience put his name on the birth certificate and then adopt him? She states that the bio father doesnt care if he does that. And if that goes through, the bio father would still have to pay support? (sounds like a similar situation that I am in) Massachuesetts

    No, she cannot. Knowingly listing someone OTHER than the father on the BC as the father is fraud.

    What would happen to her if she did it anyways and the court found out?

    If the paternity fraud is successful, it forecloses the opportunity to correctly identify the father and get a support order. If an adoption is completed, it terminates the biological father's support obligation. So either way, she should stop expecting to get money from bio dad.

    Nobody here can predict with certainty what a court would do. If bio dad attempted to establish his paternity, it is possible that the fraudulent affidavit of parentage would be set aside.
