Maternal Grandparents Asking For Temporary Guardianship

My fiancee has not seen his daughter since she was about 10 months old. When he and his ex wife divorced they had an agreement in mediation regarding visitation. Ex wife never followed agreement thus visitation did not take place. My fiancee tried to maintain contact however ex disapeared in 2003 (mail sent to chld came back "FORWARDING TIME EXPIRED") Since that time we have had no knoweldge of the whereabouts of mother or child until recently. When we saw mother and child recently (maybe last 6 month or so) we saw mom with man, presumably new boyfriend. Mom is still apparently upset at my fiancee as she still flips him off, gives him dirty looks, etc.

Received papers today. Maternal grandparents are filing for temp guardinship. My fiancee thinks that would be the best thing for daughter as she's been seriously tramatized by mother and boyfriend. However my fiancee would like to slowly be reintriduced to his daughter. Please aid us with your advice and suggestions. Thank you!

Why isn't your fiance trying to obtain custody?

My husband hasn't seen his daughter for about 5 years where as the grandparents have apparently been involved in her life. The grandparents indicate that she has no recollection of her father.

Your husband may nonetheless want to get a lawyer, to help him communicate his wishes to the court and maximize the chances that he will be permitted visitation under the guardianship. Given what you have said I would not be surprised if the guardianship petition alleges that, at least in terms of contact, he has totally abandoned the child.

I recommend that your fiance ensure that his child is appointed a Guardian At Litem and check into re-establishing his relationship with his daughter.

I am always honest when I ak these question. Technically he is my fiancee however we have been together for almost 6 years and we call eachother husband and wife.
