    Default Real Estate Contract Agreement

    In a Residential Listing Agreement contract to sell a home, do all parties (seller and broker) need to sign the contract when all parties are present?
    If the contract was signed at a later time by one party (i.e. when the seller is not present), is the contract still valid?

    Default Signing a Contract

    Under a typical "statute of frauds", a contract for the purchase or sale of real estate must be in writing, and that writing must be signed by the person against whom it is to be enforced. Beyond that, there is not typically a requirement that the parties to a contract sign at the same time and place.
