    Default Filing a Personal Injury Claim on a Worker's Comp Case

    I am on workman's comp due to an injury on my right shoulder. The Dr. has stated that it is permanent and stationary. My work is willing to provide modified work to accomodate me, however, my injury caused me to drop out of school for auto mechanics which I now have to pay back loans up to 25,000 dollars. Can I file a personal injury claim on this?

    Default Workers' Compensation & Tort Claims

    As is explained in this article on workers' compensation as the exclusive remedy, in most cases it is not possible to bring a tort claim, but sometimes it is - particularly where the injury is caused by a third party (somebody other than the employer or a co-employee).
