Default Effect of Dismissal of a Collections Lawsuit in Massachusetts
I have a credit card debt that was charged off from providian back in 2003. It then was sold to another collection agency, callled arrow financial LLC. I received a letter from district court that i was sued by Arrow Financial LLC, and that the case was dismissed and they were awarded no money.

Since the case was dismissed, do they still have the right to collect the debt or do they have to remove such debt off my credit report.

My other question would be this since providian sold the account to arrow, when the 7 year mark comes and the debt comes off my account will it fall off for both arrow and providian since it is the same debt?

Was the lawsuit dismissed with or without prejudice?

I looked on that i didnt see anything that said dismissed with or w/o predjudice. The only thing it mentioned that the case was dismissed and they were ordered to collect nothing.

If it was dismissed with prejudice, the litigation is over. If it is dismissed without prejudice, they can file a new action to pursue the debt. It's a big difference.

I don't have a copy of your court documents, so I have no way of knowing what they say. The clerk's office may be able to tell you, but I can't be sure of that either.
