    Default Co-Worker Injured By Driver Of A Company Car

    Hi everybody.
    I work for a national company and part of my jub (not in the union contract though) is to drive from time to time the company's car, with other coworkers in it.
    I was driving a van, I stopped and one of my coworkers got off the car in front of the building, because her knees were painful and she did not want to come all the way from the parking lot at the rear end of the building.
    I thought she was already goint towards the building and since there was nobody in the middle seat, I thought I just turn the car and park right there. At that moment she leaned back fro her staff and when I pushed the brake, the sliding door of the van hit her and she fell to the floor. She was not under the car, she was nothing close to the tires or something.
    Next day everybody was teasing me that she would be filing a lawsuit, since she already did that to 2 other workers eithin 5 years.
    I live in CT, where - if I got the correct information - nobody can file a lawsuit against the employer.
    She did file the lawsuit and she did it against me, personally.
    What can I do to prove she is a scammer, she just wants money and get retired? I can not afford a long lawsuit, I don't have the money for it.

    I can't figure out what happened from your description.

    Have you checked to see if there is coverage for this incident through your employer's insurance? Through your own auto insurance?

    Yes, they have but they don't want to pay her, because she already scammed them a couple of times, in the last few years she had a series of "weird" personal injuries. She won't be able to sue them, so she sued me, personally.
    I don't know whether my insurance will pay or not, because I was driving a company car and my insurance told me I have been insured under my company's insurance.

    You should attempt to get coverage through your employer's policy, whether or not they deem her claim credible, particularly if your own insurer is conditioning its coverage on their denial.

    Did she suffer any injuries - was she hurt? What is she suing for - what type of damages?

    I don't know yet, haven't got a paper, my insurance company has not got any papers yet. All I got is a letter from my company's attorneys, stating that the workman's comp they paid for her will be deducted from the amount of my settlement.

    Plus at the beginning she was OK ,not she states she can not move and she is in the bed. She had knee replacement last year and everybody tells me she already got insurance money from other coworkers and she was planning to retire. So I am sure she is OK, but she will get retired with my settlement. It just makes me sad, because I thought we are covered 100 percent by the company's insurance, since we have to drive the cars from time to time.

    Your ONLY chance of help is with your company's insurance company. When they told you that they don't want to cover it, that had better have been coming from your employer and NOT their insurance company. They need to file the claim. You have limited options since your company won't cover it. You can, though, call your company and ask them to defend you ONLY to the point of having the lawsuit name the company and their insurance company.
