Default Statute Of Limitations When No Judgment Is Entered
In april 2003 I was served a notice to respond regarding a credit card debt. I responded that I had no money. The attorney for the credit card company sent me a notice that they intended to pursue for a defaul summary judgement.

OK now it is just over 4 years later, I have not been contacted again. I check with the State Superior Court and the case is stil open and the Judge entered an order for us to attend mediation in July 2003.

I have not been at the serviced address for 3 years. Does the credit card SOL apply still? We never attended mediation, no judgement has been entered. I was never informed regarding the mediation. What are my rights?

the SOL will always apply, but the SOL only counts up to the time they filed the lawsuit, not up until the lawsuit is completed.

you may wish to file a motion to dismiss based on failure to prosecute. check your rules of civil procedure for the requisite time length to ensure it has passed.
