Using Quit Claims in California to Refinance

I need to find out if my daughter can quitclaim her house to my husband, so that we can then re-finance the house to get her out of a disasterous loan. The have a first and second, the second is variable (I belive) and is getting to the point now that they won't be able to pay it soon and their credit has been seriously damaged by medical bills they are unable to pay. Help!

Have you considered buying the house from her? A quitclaim would probably violate her mortgage contract.

Help! I have the exact same problem. Why would a Quit Claim bother the mortgage?

If I must buy it from her the property taxes go up. Can't I just do a Quit Claim for $10.00?

The mortgage contract would typically be violated by any conveyance of the property. Read the mortgage contract. (And please start your own threads.)
