    Default Fired After Sexual Relations With A Co-Worker

    I did not want to think it was her. All I know is "a woman complained." I think I know who.

    I have been banned from the Company, a very high profile worldwide company. I myself am fairly high profile, too. I want to know why.

    I was fired from HR. My boss did not know.

    Department of Fair Employment and Housing, CA.

    How should I file?
    * Denied employment? (I have been offered jobs after that)
    * Harassed?
    * or Other_________

    Other = fired for retaliation/false claim/libelous claim from her against me. I believe she did this to me for not being her partner (she wanted a partner and was not happy that I wanted just FWB). I got fired 1 month after my wife started working there and she was PISSED OFF that my wife got a job there. (yes I am a dog, ok??)

    Should I file a claim for sexual harassment against her? She did touch me a few times at work. She asked me to rub her neck a few times. I did that and did not mind. Leaned against me during a seminar, and I did not like that and left. This was "FWB" (friends with benefits) and she wanted a BF.

    Hi seniorjudge,

    I have a contract through a 3rd party agency. My actual employer is the agency; not the company I was banned from.

    Yes, I know. The reason I was given is based on a lie.

    I still want to know what to file for with DFEH.

    As stated, I have been banned from the company. I've since been presented with better paying jobs from other departments.

    I got more than fired, and for a false reason.

    and you reported these actions to whom when they happened and before you were fired?

    Sounds like retaliatory actions (which are often suspect) to me.

    and what did you expect? if a company sees a problem like this, they take corrective action so their employee can't sue them. With what you stated, and the tone of the explanation, I wonder who was the agressor, you or the girl. I suspect it wasn;t the girl.


    as an outsider, you were a guest. Didn;t anybody ever tell you the joke about the traveling salesman and the farmers daughter? How about " a pig doesn;t shit where it sleeps"?



    throughout your posts, you never did state the reason you were given for the firing.

    Who cares what your suspicions are? I'm not here to put on an act. I got fired. And it was a long time after she invited me over to her house, and asked me to her bed. I want to know why.     Other = fired for retaliation/false claim/libelous claim from her against me. This one requires evidence to be valid. If I can find out why I was fired, well that would be evidence. However, in order to find out why I was fired, I'll probably have to file a claim.

    I want to know why I was fired. I want to see personnel records from that company. I can't get any answers.

    One thing I can say is that I was not fired for performance reasons. My performance was great! I worked 40-50 hrs/wk. Billed only 40. I worked hard and got a lot done. My boss did not know I was being removed. The event was a big loss for the team and they have told me this.

    you still did not state the reason you were given for the discharge. From what you have posted, you have no claim for harassment or unlawful discharge.

    You have no right or claim to see private records (referring to your personnel records). Apparently you got all the answers they care to give you.

    So, file the thing anyway you want since there is apparently no proof to sustain your claim and it will get tossed.

    unless you had a contract with them, they need no reason to discharge you. If they felt that you being there presented a problem with their employee or the company, they are well within their rights to let you go, false claims or not.

    IF the woman lied about you, you may have a defamation claim against her but the employer still does not need a reason to fire you and the problems the two of you were having are plenty of justification to let you go.

    The event was a big loss for the team and they have told me this.
    Apparently the powers that be didn;t feel your contributions were great enough to overcome the problems your presence caused.

    Unless you have some evidence (other than " I can guess" or "I believe " ) there is nothing to sustain a claim.

    @ judge - After carefully reviewing the company policy on such claims, I don't see anything about 'farmers dauthger'. They do offer AAA arbitration, though.

    @ jk - they said 'a woman complained.' That's all. They won't talk any more. Frustrating, isn't it? They even harassed my wife about it; warned her about me, but they won't tell why her either.

    Step 1) Find out why I was fired.

    I thought filing a complaint with DFEH might help me get that reason.

    Oh, and JK, my team could all be fired and the company would still make billions.
