    Default Can Moving While On Probation Change A Misdemeanor To A Felony?

    Asking a question to verify what someone is telling me. Someone is on probation in FL, we want him transfer probation & to move to NC for fresh start. He says his misdemeanor charge will change to felony if he moves. Can this be true? I suspect he is giving false excuse to stay in current environment.

    You mean, if he violates his probation? Or if he gets a transfer of his probation?

    It may be that the new state has no equivalent misdemeanor charge, such that if he transfers his probation the charge would show up in the new state's records as a felony.

    No, not if he violates, only if he transfers. I'm not 100% sure what his charges were, but they are related to Domestic Violence/Restraining Order. We want him to transfer his probation to NC & start a business w/ his brother, but he's claiming his charges will be changed from misdemeanor to felony if he transfers.
