    Default Raided and Arrested 2-1/2 years ago

    My house was raided and I was arrested 2 1/2 years ago for drugs. The state passed the case on to the feds shortly after.
    So far I haven't heard from the feds. Someone who knows a few things about the law suggested that I call the federal court house to check the status on my case. This person also told me they may have filed the case but have not taken any action on it. This doesn't sound right. I thought once they file a case an arrest warrant is issued and marshals show up at your door shortly after. This person also told me they may have already revoked my bond which seems strange because I haven't moved and am real easy to get a hold of. Although I have changed my phone number it would seem like they would have at least contacted me through the mail service. I live 10 minutes from the federal court house so it’s no hassle for the marshals to jump in their car and grab me at my house.

    Questions

    If they revoked my bond wouldn't there be an arrest warrant for me and if so would the local city cops have knowledge of it? I was walking my dog 2 months ago and witnessed a shooting. The cops ran my driver's license and nothing came back.


    Should I contact the feds to check the status on my case? This sounds like a bad idea to me but at the same time I need to start focusing on an expungement if it’s possible.

    I would contact an attorney and let him do the checking for you.

    I checked with an attorney 8 months ago and he told me that now is not the time to be ruffling feathers. He said I should wait until the statute runs out which will be in 5 years. Maybe he meant now is not the time to peruse the expungment.The thing is I will be finishing college this fall. This latest arrest will not look pretty when I go in front of the licensing board.

    Did you post bond through a state court, or through the federal court? It sounds like you posted through the state court.

    I have never heard of anything happening as a result of contacting a court clerk and asking them to check if they have records of any criminal cases under a specific name. The clerk's office is separate from the prosecutor's office. I tend to agree with your lawyer, though, that it is sensible not to do something which might wake up a U.S. Attorney's office about a case that, for some reason, may have fallen through the cracks. (It may be that the U.S. Attorney was a lot less enthused about getting the case, than the state authorities were in sending it to his office.)

    Yes, I was bonded out through the state court. I guess that means when a cop runs my drivers license a warrant will be in the files if in fact my bond was revoked. I think its safe to say that the bond hasn't been revoked.
