Involved in a car accident while I was at work (not my fault) went to workman's comp Dr's said MMI Permanent Partial Disability like 10%. Not to lift over 20lbs nothing overhead etc... Went to another Doctor he sent me to shoulder specialist that stated he could fix. Had surgery two days later. In the mean time Workman's Comp stopped making payments because they deamed me MMI. The surgery that was done involved a ligament transplant so it will take 15 months to hard heal to be able to use as before. Before surgery I did not have a minute without pain and did not sleep most of the time. After the surgery unless I use it (not suppose to) minimal pain able to sleep. My private work insurance (after fighting with them up to one hour before the surgery) paid for the surgery. My work then fires me so I have to make cobra payments because they received the letter from workman's comp saying that I was permanetly disabled and would not be able to lift and do my job(even though I provided them with a letter from the doctor that did the surgery). I have a lawyer although it seems he might be in over his head. Workman's comp and my personal insurance have put a lean against my claim for damages from the woman that hit me. Cobra is over 700 a month and I have no income coming in. Physical therapy is going to be tough without insurance. Its like a catch 22. Anyones suggestions will be greatly appreciated.
As you are represented by counsel, you would likely benefit from schedling an appointment with your lawyer to discuss your case and to have your questions answered. If that doesn't satisfy you, you may wish to seek a consultation with another workers' compensation lawyer in your state.
