    Default Held Prisoners In Our Own Home

    First of...Lord help us..we live in Alabama..we bought a cute little "fixer-upper"and for the first year everything was fine...then the neighbor's brother got out of jail..moved into the "family home" with her..brought in his 2 juvinile deliquient sons...drove the sister out...proceeded to bring in his ex-wife and her 17 year old juvinile delinquient..now...let's throw in the 30 year old nephew who for the last 2 years has come and gone at all hours of the night...burned down the shed on their property at 3 in the morning...no...of course the were'nt cooking drugs...for the last 2 weeks..there has been non-stop target practice going on within 10 foot of my property...last tuesday the 2 younger boys were suspended for making death threats at school..the little gasng is known as TYK...true young killers...now that they are'nt in school...they roam the woods behind the house with a pellet gun and a 22...we had to put upma fence between the properties recently...that sent the 3 boys into a rage...these adults have the ability to stay awake for days...what are my rights as far as feeling safe on my own property?

    Try notifying their probation or parole officers of any questionable conduct.

    no sir...I was being a smart butt...we have finally come to the realization that no matter what these people do..nothing will happen...as of the first post of mine..the nephew has gone back on the road for 2 weeks in his semi...the one on parole has a warrant for writing bad checks...the wife has an assult charge against her for shoving the assistant principal. the law came by 2 times and they hid inside..that has been about 4 days ago..and no law has been by since...we (my husband and I) have decided to give up the fight..we can't feel safe here anymore..nor can we even have the benefit of having company because you really never know when the shooting will start..my question to you sir now is...since the property next door belongs to an estate...can we go to small claims court and possibly sue the estate for closing costs on the new home we are having to purchase..and maybe possibly some pain and suffering and moving costs...honestly the money would be a mute point...but the aggrevation on their part would be a small victory on our part...thank you for your time...

    A response which might have merited a sarcastic reply from you would have been, "It's easy... first you get a magic wand, and then you wave it, and all your troubles go away." But I think we both know that there are no magic answers. Unfortunately I can't make your local police do more, nor can I make you follow my suggestion of trying to involve their parole or probation officers.

    I'm not sure what you mean, that the property next door "belongs to an estate". It's currently in probate? Perhaps you can purchase it from the estate and evict your neighbors.

    If they have weapons and are convicted felons. They are committing a crime. Felon in possession of a firearm. That is another felony which could put them back in jail or prison. Look up your state laws for firearms, felons in possession which is under federal law. They most likely obtained the firearms illegally if they are felons. Look up the brady act. If your local police are not helping talk to the chief or sherrif. If that does not get you no where contact the state police. If that does not do any good for you go to the state attorney general. You have rights.

    Parole or Probation Officers usually have a heavy case load and will not check into a problem you have with one of there cases.

    If you are hearing automatic firearms contact the ATF or FBI. As possession of Fully Automatic Firearms are a federal Crime, which will put them in federal prison. Then I will have to deal with them on a daily basis.

    Unfortunately your problem is not a real estate problem it is a criminal problem. Most likely the reason your neighbors may seem like they never sleep is because of the use of illegal drugs once again another felony.

    I had the same problem where we live. We moved to a mobile home. The
    MH next door was trashed.. and like you, people coming and going at all hours, no discipline with the parents, etc, etc.

    I just started making calls and sending emails. Go to your COUNTY website.
    Email: Code Enforcement Officer

    Call Department of Health.. They have to do an inspection.. Just this alone
    will scare some people into action.

    If Children are involved: Call the Child Welfare Department.

    Before long there will be so many "officers of the court" over there that they
    will become paranoid and either move or clean up their act.

    The police will do nothing, however, you could call in a "welfare check",
    being a concerned relative stating that you haven't heard from them and
    wanted the police to check on their welfare.

    That way, when the police do go onto the property, if they see anything
    suspicious, they will investigate it.

    My neighbors cleaned up their act, the yard is clean, and I can now
    hear the crickets at night!!

    All you can do is try...........................
