Question Help Responding To A Summons
Received a Summons Friday the 11th. I am in Washington State. I need help with a couple of things. Have been researching on the web and would like to know How do you find the state info on Statute of Limitations for open or revolving accounts? Found several sites that say it is 3 years in Wa. but would like to confirm that. Been all over the state laws site, called State Attorney no one can help. Also would like to respond to this summons but am unsure of the how toos. Do I get something from the courts, do I just send a response certified--need help with this? Should this end up going to court what kind of evidence do I need to show 3 year SOL. I can not find anything pertaining to this home depot card. I believe it has been 3 years because it shows on Credit Report as estimated date that this will be removed is 02/2011 but it can't be that simple? Thank you for any help you can give me on any of this.

Standard answer on expired SOL (statute of limitation) and/or validation and/or dispute letters. There are thousands of posts similar to yours on this forum so I have prepared a standard answer.

SOL (Statutes of limitation are DEFENSES to lawsuits; they do NOT provide a method to stop someone from suing you. This defense means when they sue you, you answer with the defense that it is barred by the SOL.)

Make sure you ask for VALIDATION (and do not accept verification).


Disputes: You can write a letter of dispute to the three credit reporting agencies.
