    Default Propertly Line and Wrongly Placed Wall

    We had a survey done and found out that a masonary wall, we want to replace because it is ready to fall, should be moved over onto it's proper place which is about 2.5 ft at one end and 6 ft at the other onto our neighbors side which is really our property. Per the survey!
    Our neighbor thinks our surveyor is wrong and says since he's lived there longer than 5 years, this percriptive easment makes it his. We pay taxes on it and it's ours. HELP He doesn't need to cross this piece of land to get to his house or anything like that. We are even willing to pay for the entire deal. YUCK This is hammpering on our addition plans and is putting a strain on our neighborly friendship. Need advise fast. Anyone????? Plus it will all be done with permits!! Can he file and appeal or injunction to stop us. Also there is a shed of his that has to be moved. What to do???

    Default Moving Misplaced Wall

    You need to consult a local real estate lawyer about your rights and remedies, as this wall is removed and rebuilt.
