    Default Statutory Rape And Statute Of Limitations

    I have an aquaintance that is involved in a relationship with a 19 year old and he is 43. Their relations began when she was atleast 17 but possibly earlier. They are residents of Florida and he is a teacher. What is the statute of limitations for this type of offense and what would a course of action be to prosecute this individual?

    § 794. 05
    Unlawful sexual activity with certain minors if someone age 24 or older engages in sexual activity with someone age 16 or 17.
    Up to 15 years in prison

    It appears to be a 3rd degree felony.

    The statute of limitations on this type of offense is 3 years after the commision of the offense. However, the SOL does not begin until the victim turns 18, or if it does get reported to law enforcement or other government agency, the 3 years starts at that time.

    The victim could file a civil suit which has a 5 year SOL.

    The first course of action would be to report it.

    After reading this it is a second degree felony, and that has the same SOL information as I gave earlier.
