Default Re: Injured Worker Dealing With A Texas Insurer Outside Of Workers Comp

Yet another twist.... We had a hurricane this past week and upon my arrival home I find a soaked fedex envelope cntaing a letter from my employer stating that if I didnt return to work by9/14 at 9am then I would be considered "self terminated", but heres the deal, I had a new doctors excuse taking me off of work as of 9/14 8:51am. I received a letter in the mail today stating they terminated me because I didnt show up. i faxed the doctors excuse to my employer and everyone involved on 9/14 when I arrived home. So now, do I have a wrongful termination suit as well???

One good thing about Texas W.C law if the employer does not carry it W.C,then W.C awards are not the exclusive remedie. I agree with Arron you need to talk to a W.C lawyer. A damage award at a Jury trial could go beyond what W.C pays.

I have an attorney but I wanted to get a few opinions on here concerning a wrongful termination suit.

Your attorney should be able to give you more advice than anyone here.
