Default Questions About A Collections Letter
So I received a letter from Stewart & Associates. P.C. saying I had ten days to set up payments or they will take further legal action....I just mailed them yesterday a letter for debt validation...in the meantime my question is can they if they take me to court do anything since I don't work? or will they still garnish my wages or such thru my husband? Is the SOL up since my acct. went into default in 2001?

Hi - what is the name of your state, please? Are you in a community property state? What type of debt is this - credit card? The SOL differs for different debts. Thanks.

I am in Georgia...this is a credit card...I just pulled my credit report and they just put this on my report in 03/2007...no payment history for me to see either....they have told me two different dates when it went into default june 2001 and sept 2001...how can I know if that info is not on my credit report?

The first thing to do is to send them a letter CRRR requesting verification. What is the amount?

To answer your question re if you were sued in court & they got a judgment against you - since Ga. is not a community property state, your husband would not be responsible for the credit card debt if it is in your name only. However; besides seizing your non-exempt assets, they could seize jt. assets of you & your husband - any non-exempt assets that have your name on them also. Assets in your husband's name only should be exempt from seizure.
