I have been hit with a summons from capital one also.

They sent court copy of statement dated Dec of 02. My last payment was 4/02. They verified this when I asked for validation.

Can they go by the amount of the Dec bill to try to collect, or do they have to go by the amount when my account was actually 30 days late?

They will use your current balance, which may be greater than that reflected on your last bill due to additional late fees, interest, or other penalties.
