Unhappy Fired After Returning to Work
Been on workman's comp benifits since 10/06, doctor released me to try 4 hours a day for a month and return to see how leg was doing...
I worked one week, starting the second, week, on Monday, my employer handed me a letter stating, I was no longer needed as they needed someone who could give them 40 hours a week plus overtime when needed. Have been with the company for 30 years. I live in Virginia. Can this be done, also cut out my health insurance out back in Jan..Do you think I need to get a lawyer?? I am still receiving Workman's Comp benifits, said I would get my whole benifits till court date or doctors appointment.
Have recieved a letter from My Workman's Comp company and we have a court date in June. Is this to see if I quailify from more benifits, they are requesting I bring all medical records and doctors letter with me.
Please advise...

I don't know enough about your termination to determine if they had a valid basis for terminating you, so I suggest you talk to a local workers comensation lawyer. As for your benefits, if you no longer qualify for participation in the employer's plan, the termination is probably not illegal. In most circumstances you would be eligible for COBRA continuation, and should have been informed of that right.
