    Default Automatic Stay and Disclosure of Information

    I recieved a letter from a lawyer wanting to make a motion to lift an automatic stay 362 on my home mortgage ( I am in a chapter 13) The letter was sent to me,CC to my lawyer, CC to the federal judge.My question is at what point and time does this become public information ?Is it public information before the judge recieves it and it is moved on or does a hearing have to be held on it before it is considered public information ? A lady I know that works who at the bank whos lawyer is wanting to have the stay lifted lives down the road from me and was yapping about it about 2 days after I got the notice in the mail. I am trying to determine if anything was done illegal on the bank employees part.

    What exactly is she saying? That you filed for bankruptcy protection and the bank is attempting to get excused from the automatic stay? If you received the court filing, it seems reasonable to infer that the court has as well. Court records are public records, and absent unusual circumstances anybody can discuss the content of a court record. This may be a violation of the bank's policies, but that's not something you can enforce.
