    Default Time limit to file a medical malpractice claim

    My mother had breast cancer and did not know it. She was going to a local clinic for two years with chest problem and was told that there is nothing wrong with her and they just prescribe pills and send her on her way. After two years of that she decided to go else where and then found a lump in her breast but because the cancer was so far long they had to remove one of her breast. If the clinic had done proper test at the time my mom would still have her breast. Its been 11yrs but she still have pain from time to time. Is there still something that she can do about this????

    Default Failure to Diagnose Breast Cancer

    Failure to diagnose cancer is a continuing problem. Sometimes it is not the fault of the health care provider; sometimes it can give rise to a malpractice action. Unfortunately, under Texas medical malpractice law, medical malpractice actions must be commenced within two years of the act or omission giving rise to the injury, but not more than ten years after that date, so it may be too late for your mother to pursue a claim. She should consult a local malpractice lawyer about her situation.
