Default Collection of Credit Card Debts
I have a credit card account charged off and sent to a collection agency. I live in NC. Can they take out a lien on a house if the property is jointly owned (my husband and my name on deed), but the debt is in only my name? Also with a bank account, can they levy it if it is joint?
The collection agency is in New York. Do they have to be in NC to be able to do anything?
I have been told to send them a letter of validation before I speak with them. Is this the right thing to do, or should I speak with them to see if a payment arrangement can be done?

They would need a judgment before they can engage in garnishment and execution through the courts. If they do act through the courts you can expect them to use a North Carolina law firm. (Why did you originally title this thread "judgment"?)

Because I have a question about a judgement. MY question still is if a judgement is taken out can they attach a lien on property that is jointly owned, but the debt is not? Can they do this with a joint checking? Please advise?
Has anyone dealt with Creditors Interchange, in Buffalo New York? If so, please advise on them.

The answers to your questions depend on state law.

Have you talked to a lawyer in your state?
