Default Capital One Credit Card Judgment
I have been sued by Cap One and have lost. This card was in my name only. I lost my job and currently stay home and take care of the kids. My question is can they sue my wife or if they come and try to liquidate property can they if it is joint property? I live in Missouri.

Missouri is not a community property state - therefore, individual debts remain separate - - unless you have accts. that were opened jointly. (If you're name is anywhere on it, they could try to seize it.) Assets under your wife's name only could not be seized.

Also, what can they do? In the court house I told them I do not work, also told them this prior, and was called a liar. According to one of the CRA's it states I still work for CVS as a store manager. I have not worked for them since 2005. And the bank account is my wife's name only, we rent, we do not own any property. I stated they were wasting their time. So what happens next?

Since you were sued & lost & they have a judgment against you, they can seize all non-exempt assets in your name. If you have no assets at this time, then there will be nothing they can seize. If in the future, for example, you open a bank acct. in your name & they find out about it they could seize that money.
