How Can I Find Out My Ex's Immigration Status

Here's the story. My current husband would like to adopt my two children. I believe that the bio-father is here illegally. How can I find out for sure if he's here illegally or not? I'm hoping if I can prove he's here illegally, court procedures for the adoption could go smoother.

I suspect that she hopes that a court won't grant custody to an undocumented immigrant, or that he'll be deported and won't be able to obtain custody.

Outside of an employment context, where you can still be tricked by false documents, I don't know of any easy way to find out if somebody is undocumented or not.

Just to clarify, is that a possibility? I wouldn't think so, but I am not a lawyer.

DHHS has been looking for him ever since I put the kids on Mainecare about 2 years ago and haven't been able to find him. I was just hoping that if I could prove he's here illegally it would make the process of serving him notice of the adoption alot easier.

They will serve him if their process server can find him. Apparently he is avoiding service. I do not see how knowing his immigration status would make it easier for their process server to find and serve him.

And if they cannot find him, he will be served by an advertisement in the local newspaper.
