    Question Suing The State To Collect Damages From An Uninsured Driver

    My vehicle was parked leaglly on the road. A driver hit it. He produced all the information for the officer, but I found out later his insurance was no good. I took him to court for $3000 small claims, for damages to my vehicle. I won. He can't/won't pay. He is on disability, and fixed income, ect. This is where I am supposed to give up, right?
    I heard a story of something very simular where the victum sued the state of michigan, for the uninsured motorist, and won? The state paid damages to the victum, and then went after the offender. Is this a myth? I realize it is a long shot, but I'm begining to get desperate. Any advice?

    P.S. I even set up a payment plan for the offender, $20 a month, for $3000, through the court, and that would be paid in about 13 yrs... He defaulted without 1 payment. I could have kicked myself for agreeing to it in the first place.

    You seem to be thinking of the assigned claims plan, which relates to physical injuries. In terms of vehicle damage, Michigan's a no fault state and drivers are responsible to insure their own vehicles for damage. If the court didn't do so, try registering the judgment with the state as a financial-responsibility judgment. Sometimes drivers become a lot more willing to pay judgments when they find out that their driver's license will be suspended.
