    Default Does Buyer's Agent Get a Commision if Listing is Temporarily Off Market

    Another Temporarily Off Market Question:

    An MLS Listing shows TOM (temporarily off market) and an Agent writes an offer for his buyer. The seller accepts the offer.

    Will the buyer's agent receive the commission shown in the MLS listing?

    Default Contract with Real Estate Agent

    The obligation to pay the commission will depend upon the terms of the contract. As you are describing the possible commission as being for the buyer's agent, the contract to examine would be that between the buyers and their agent.

    Thanks Aaron,

    There is no signed contract between the buyer and the realtor submitting the offer. The only contract is between seller and listing agent. Listing agent has disappeared-long story, suffice to say seller wants to sell home. Buyers realtor implies listing must be put in 'active' status in order to be paid.

    A definitive answer would still require (IMHO) review of the contract.

    There's no chance of getting a release from the listing agent's agency?

    Hi Aaron,

    Have tried repeatedly, but broker refuses to release me. Have attorney working this, but meantime buyer (who my listing agent knew of and refused to present) still wants to buy my home. (Buyer is qualified).

    Not trying to avoid paying commission. Trying to figure out the rules (its like playing in a game where only the other team has the rulebook!)

    Don't know what IMHO is.
