    Default Tree Damaged My Fence

    The owner of the house behind mine was cutting down a tree near the property line on his side, part of the tree fell onto my fence and caused some damage.
    He wants me to trim the tree back on my side so he can cut the tree down all the way before fixing my fence, but i don't feel safe triming a tree that has power lines going to my house under it.

    Whos responsible for the tree if the base of the tree is on his side of the fence?
    If hes responsible for it can i force him to cut/trim it back to his side of the property line?

    If hes not willing to do it how can i find out his home owners insurance for this property?

    If you don't want to cut the branches, you don't have to. If you want to cut the branches on your side of the fence, cut them or hire somebody to cut them (but don't expect your neighbor to foot the bill).

    If he's not going to fix the fence and won't give you fair compensation for the damage caused, consider suing him in small claims court.
