Shoplifting at Kroger

I was caught shoplifting eyeliner (yes, so stupid) at Kroger two years ago. I went to court as my first offense. They charged me with a misdameanor. I was placed on court supervision for one year. I am now applying for a job and I was told they may perform a background check. I am 21 years old now and I've completed my court supervision with no problems. Will this whole incident show up on my record?

I take that back, it's been so long I was issued 6 months court supervision not one year. It will? :shock: Do you have any idea what it will say? How do I get this off my record? Is there any way to do that?

Unless there is something that you are not telling us, such as a delayed disposition, when your guilty plea was entered it became part of your criminal record.

You may wish to review the materials on the Illinois State Appellate Defender's website to see if you qualify for an expungement, and for information on the application process, although it looks like there's a five year waiting period for expungement of a conviction under Illinois statute 720 ILCS 5/16A-3 (Retail Theft).

If you plead guilty to a crime in Illinois and receive court supervision, not probation, you will not have a criminal record as long as you complete the supervision without being arrested again. Any criminal background check run on you will show no convictions. Technically the only record you will have is that you were arrested, and this information can only be accessed by law enforcement angencies, not a private corporation that runs background checks.

Ok, that was my question also. Because what your saying is exactly what my lawyer said too. He said after supervision is served it's not worth expunging because their really isn't anything to expunge. They drop the charges. If they really wanted to dig super hard and made enough phone calls (an no job is going to do more than a back round check) even if you did get it expunged they can always find out you were arrested in the past but all in all an arrest doesn't mean a conviction.

After looking at the link Arron posted above you can "Petition to Seal Arrest Record" after 3 years. But an arrest alone (you served your supervision so no charges are on your record) shouldn't keep you from getting the job.
