What To Do After Getting An Expungement

I was convicted with a misdemeanor in Orange County, CA in 2001. I got a 1203.4 and got an expungement in 2003. I got a letter stating that the case is removed and plea of guilty is changed to not guilty.

It's 2004 and I applied for a job. It got denied based on the background check. I have never had a prior in my life except for this. When contacting the agency that did the background check, they told me my conviction is showing up on the multi-state criminal history. Why is this and is there a way to change this? Who or where do I call or go? I called the court where i was convicted and they told me it shouldn't show up? Can anyone explain? Thank you sooo much.

You should first try to find out what directory they are using, and whether it is publicly or privately maintained. You then need to track down the owner or proprietor of the directory, and ask that they correct their information.

Depending upon the information conveyed, if they provided incorrect information that cost you employment, you may wish to discuss with an attorney in your area the possibility of a defamation action. It is not immediately apparent that such an action would be successful, but given the typically short statute of limitations for a defamation action you should investigate that possibility sooner as opposed to later.
