Grandparents Wish to Help Teen Emancipate

We have 2 grand children ages 10 & 12, the 12 year old grand child now living in another state and wish's to emancipate and live with us. Her mother and step dad moved to the new state much against her will. The parents are not doing well job wise and the grand children are left alone most every night. We maintain contact every evening by phone as we are worried to death for their safety. My question is, is this a possibility?

A rhetorical question if I've ever seen one...

Emancipation, in general terms, is a process which makes a minor legally independent of parental control. There's no state which will emancipate 10- and 12-year-old children.

Are you the maternal grandparents or the paternal grandparents? Where's dad in all of this?

a 12 yr old cannot be emancipated. and they can choose where to live when they are 18.

You're not talking about emancipation. You're talking about a change of custody.

Emancipation is a non-starter. There is no possible way emancipation (which does not mean a transfer of support from a parent to someone else, but frees the minor from all adult support) will happen for a 12 year old. The youngest age any state will even consider emancipation is 14; only California will consider emancipation as young as 14, and to be emancipated at 14 in California you'd better be either a successful child actor or a nationally recognized sports figure.

A change of custody, however, is not impossible. There's no guarantee, of course, if the parents object. But it's at least within the realm of legal possibility.
