    Default Working For Cash

    I live in Wisconsin and have filed for a uncontested pro se divorce.My wife and I are living together.We plan on separating after our house is sold.I am on disabilaty and she works.The problem is that she works for cash.I have been trying for years to get her on the payroll.Also her hours are flexible so she can work as much or as little as she wants.because of this I dont have any way to document her wages.Her income could be much higher if she just put in more hours.How will this afect our divorce,suport,alimony.

    You say she "works for cash" - do you also mean that she doesn't get a 1099 from her employer reflecting her earnings, and doesn't pay her taxes?

    One of the problems of acquiescing in the non-reporting of taxable income when you are married is that it is much trickier to establish that the income exists when you get divorced. I suggest you get help from a good divorce lawyer.

    If we both agree to a dollar figure for her income and support will the court approve our agreement

    For property division and spousal support, courts offer great deference to the parties' agreements. (Child custody and child support settlements are subject to greater review.)
